Terms & Conditions With Refund Policy
Below are the general terms and conditions with refund or cancellation policy governing the Learning Management System (LMS) Or Delivery Management System (DMS).
1. Decision and Enrollment Process
Prospective participants are strongly encouraged to attend the Demo/Webinar sessions provided by CloudAge before committing to the course. This allows Candidates to make an informed decision regarding their enrollment.
Should participants choose to proceed with the course following the introductory sessions, they are required to initiate either partial or full payment of the course fees as per the payment terms specified by CloudAge.
Candidates can make payments via cash, bank transfer, online payment (as provided by CloudAge), or cheque (subject to clearance). Installment plans (EMI) are available through methods authorized by CloudAge, subject to approval. CloudAge reserves the right to modify payment options at any time.
CloudAge maintains a strict no-refund policy. Once enrolled, if a candidate decides to cancel their enrollment at any stage during the course, any fees paid, whether partially or in full, are non-refundable under any circumstances. This policy applies to all participants without exception.
Candidates who have paid the course fees, either partially or in full, and are unable to continue with their designated program due to unforeseen circumstances may request to join a subsequent batch. Re-enrollment is subject to CloudAge’s approval and availability. If approved, candidates will be required to pay only the difference in fees, calculated based on the new program's fee structure minus any amounts previously paid.
7. Learning Management System (LMS)/Delivery Management System (DMS)
Will be made available to the Candidate for ONE(1) YEAR from the date, they make the payment of the course fees.
8. CloudAge
Reserves the right to deactivate LMS/DMS access if the Candidate fails to pay the complete fees for the course or if CloudAge finds out or suspects unauthorized usage of the LMS/DMS or any unethical Practices.
9. Suspension of LMS/DMS Access
CloudAge reserves the right to suspend or terminate a candidate's access to the LMS/DMS without prior notice if the candidate engages in any of the following activities:
- Inappropriate Conduct – Any form of abusive, offensive, or disrespectful behavior towards instructors, staff, or fellow candidates.
- Threats or Violence – Any discussion, promotion, or insinuation of violence, harassment, or harm towards any individual or entity.
- Unethical or Illegal Activities – Engaging in fraud, cheating, or any activity that violates applicable laws or CloudAge's policies.
- Disruptive Behavior – Any action that disrupts the learning environment, including excessive spamming, hate speech, or intentional disturbances.
CloudAge maintains a zero-tolerance policy for such actions and may take further legal or disciplinary action if necessary.
10. Website and Software Usage
The website and software, whether made available online or offline and associated with the Services, are protected under copyright laws, international copyright treaties, and other intellectual property regulations. CloudAge strictly prohibits the activation, use, monitoring, copying, or testing of its services for any purpose related to comparative analysis or benchmarking commissioned by LMS/DMS. CloudAge reserves the right to suspend the provision of services and access to its products if there is even a suspicion of such activities. Any violation of these terms and conditions, or disputes arising therefrom, will be prosecuted under Indian laws, including the Indian Penal Code (IPC), Civil Law, the Indian Contract Act, and the Information Technology (I.T.) Act. The jurisdiction for such legal proceedings will be exclusively in Pune, Maharashtra, India.
11. Ownership and Use of Course Content
The ownership and usage rights of the courses and related content offered through LMS/DMS are governed by copyright laws. During the enrollment period, Candidates are granted a limited, non-transferable license to access and use the course content.
- Only the registered Candidate with authorized login credentials may access the platform to consume the course content. Users must safeguard their login credentials and ensure they are not shared with others.
- Candidates are strictly prohibited from engaging in reverse engineering or any other unauthorized actions involving materials provided by CloudAge through its platform.
12. Modification of Terms and Conditions
CloudAge reserves the right to modify or update these Terms and Conditions (T&Cs) at its discretion, without prior notice or acceptance by the Candidate. For contracts that include automatic renewal clauses, such modifications will take effect only from the first tacit renewal, providing adequate time for Users to review the changes and act accordingly within the stipulated contractual period.
13. User Responsibility
Candidates are responsible for regularly reviewing any updates or changes to the T&Cs to ensure compliance. Should any changes be unacceptable, the Candidate may terminate the agreement as per the provisions outlined in the contract.
By proceeding with the enrollment and payment process, candidates acknowledge their understanding and agreement to these terms and conditions. It is the responsibility of each candidate to fully understand these terms before making any financial commitments related to the course.
